We operate the website https://wizread.io, the WizRead Desktop application, and any related software products, APIs, and services that refer or link to these legal terms (collectively, the “Services”).

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and WizRead, concerning your access to and use of the Services. You agree that by accessing or using any part of the Services, you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time. We will alert you about any changes by updating the “Last updated” date of these Terms of Service. It is your responsibility to periodically review these Terms of Service to stay informed of updates. Your continued use of the Services after the date revised terms are posted will indicate your acceptance of such changes.

WizRead provides an innovative desktop e-reader application, reading tracking tools, and related web services designed to enhance the digital reading experience.
Subject to your compliance with these Terms of Service, WizRead grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the WizRead Desktop application on compatible devices solely for your personal reading and productivity purposes.
You may not reverse engineer, decompile, disassemble, modify, or create derivative works of the software, except to the extent such restriction is expressly prohibited by applicable law.
We are the owner or the licensee of all intellectual property rights in our Services, including the website design, software source code, databases, interface designs, audio, video, graphics, brand names, and logos contained therein (collectively, the “Marks” and “Content”).
Our Content and Marks are protected by copyright and trademark laws around the world. The Content and Marks are provided in or through the Services “AS IS” for your personal, non-commercial use.
Except as set out in this section or elsewhere in our Terms of Service, no part of the Services and no Content or Marks may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
WizRead is a local-first software application. You retain complete ownership of all digital books, documents (e.g., EPUB, PDF files), highlights, notes, and annotations that you import into or create within WizRead Desktop.
Your Responsibilities: You represent and warrant that you own or have obtained all necessary licenses, permissions, and rights to use, format, and read any files that you load into the software. WizRead is an independent reading software tool; we do not host, sell, distribute, or provide copyrighted book files. You agree not to use the Services in any manner that infringes third-party copyright, trademark, or intellectual property rights.
General Audience & Rating (4+): WizRead Desktop is a general-purpose digital book reader rated 4+ (suitable for all ages). Anyone of any age may use WizRead Desktop locally and offline to open and read their own book files without creating an account or providing any personal information.
Online Accounts & Digital Age of Consent: To register an online account for cloud synchronization, reading streaks, and community features, you must meet the minimum digital age of consent in your country of residence (at least 13 years old in the United States, 14 years old in Italy under the Italian Privacy Code, or up to 16 years old in certain EU member states under GDPR Article 8). If you are a minor under the age of legal majority in your jurisdiction (typically 18), you represent and warrant that you have obtained the permission, consent, and supervision of your parent or legal guardian to register an account and agree to these Terms of Service.
User Representations: By using the Services, you represent and warrant that: (1) you have the legal capacity to agree to these Terms of Service (or have obtained parental/guardian consent if a minor); (2) you will provide accurate registration information; (3) you will not access the Services through unauthorized automated means (bots, scrapers); and (4) your use of the Services complies with all applicable laws and regulations.
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately at support@wizread.io of any unauthorized use of your account.
You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:
The Services may allow you to submit feedback, suggestions, feature ideas, bug reports, or customer support messages (“Feedback”).
By submitting Feedback to us, you acknowledge and agree that: (1) we are under no obligation of confidentiality with respect to the Feedback; (2) we shall be entitled to the unrestricted use and dissemination of such Feedback for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you; and (3) you warrant that your Feedback is original or that you have all rights necessary to submit it.
We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Terms of Service; (2) take appropriate legal action against anyone who violates applicable law or these Terms of Service; (3) suspend or terminate accounts in our reasonable discretion for material breach; and (4) otherwise manage the Services in a manner designed to protect our rights and property and facilitate the proper functioning of the software.
These Terms of Service shall remain in full force and effect while you use the Services. You may terminate your account at any time by requesting deletion via the app or by contacting us at support@wizread.io.
We reserve the right to suspend or terminate your access to online account features if you materially breach these Terms of Service or applicable laws.
We reserve the right to update, modify, or release new versions of the Services at any time. We strive to maintain continuous availability of our online sync features, but we cannot guarantee uninterrupted uptime. You agree that we have no liability for any temporary downtime, maintenance windows, or connectivity interruptions.
These Terms of Service and your use of the Services shall be governed by and defined following the laws of Italy, without regard to its conflict of law principles.
If you are a consumer resident in the European Union, United Kingdom, or Switzerland, you also benefit from any mandatory statutory consumer protections provided by the laws of your country of habitual residence.
To expedite resolution and control costs, you and WizRead agree to first attempt to resolve any dispute, controversy, or claim informally for at least thirty (30) days by contacting support@wizread.io before initiating formal proceedings.
Except where prohibited by mandatory consumer protection law, any legal proceedings arising out of or related to these Terms of Service shall be brought in the competent courts of Rome, Italy, and you and WizRead consent to personal jurisdiction in such courts.
European consumers may also access the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to update information on the Services at any time without prior notice.
THE SERVICES AND SOFTWARE ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
IN NO EVENT WILL WE, OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CAUSE OF ACTION, OR EUR 100, WHICHEVER IS GREATER. CERTAIN JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OF CERTAIN DAMAGES; IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY.
You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable legal fees, made by any third party due to or arising out of: (1) your use of the Services; (2) breach of these Terms of Service; (3) any breach of your representations regarding intellectual property rights in files you load into the software; or (4) your violation of the rights of a third party.
Because WizRead Desktop stores your books, annotations, and reading database locally on your device, you are solely responsible for maintaining regular backups of your personal files and computer data. WizRead is not liable for data loss occurring due to hardware malfunction, operating system issues, or local file deletion.
For cloud-synced account data (such as reading streaks and profile statistics), in-app account deletion deletes your records from our active database immediately in real time, as detailed in our Privacy Policy.
Visiting the website, using the desktop app, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communication be in writing.
These Terms of Service and any policies or operating rules posted by us on the Services constitute the entire agreement between you and WizRead. Our failure to enforce any right or provision of these Terms of Service shall not operate as a waiver of such right or provision. If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision is deemed severable and does not affect the validity and enforceability of any remaining provisions.
